Background: The Child Labor Amendment was passed by Congress in 1924 but was not ratified by the states. The amendment was in response to Lochner Era Supreme Court decisions like Hammer v. Dagenhart (1918) and Bailey v. Drexel Furniture (1922), limiting the ability of Congress to regulate child labor. Congress proposed this amendment to overturn the Court and, when ratification appeared imminent, the Supreme Court reversed course with United States v. Darby Lumber Co. (1941) and allowed federal regulation over child labor.
